1796 Lease of Tongue Fields & Dunscar Croft, Turton

This post is a transcript of the first page of a 1796 indenture I acquired a few years ago, which is a lease from John Haslam to Ralph Longworth relating to Tongue Fields and a cottage in Dunscar Croft in Turton.



This Indenture made the sixth Day of July in the thirty sixth year of the Reign of King George the third over Great Britain and soforth, And in the year of our Lord On Thousand seven hundred and ninety six.  Between John Haslam of Turton in the County of Lancaster, Farmer, of the one part And Ralph Longworth of Turton aforesaid Spinster [sic.] and Chapman of the other part.  WHEREAS John Haslam by Sundry Indenture of Lease to him heretofore made did become possessed for the time being of all those Fields or Inclosures of Land commonly called or known by the name of Tongue-Fields within Turton and county aforesaid, And likewise of a certain plot of Building Ground with Dunscar Croft ajoining to the aforesaid Tongue-Fields, And hath Errected and Builded one cottage or dwelling house thereon andsoforth.  NOW this indenture Witnesseth that the said John Haslam for and in consideration of the yearly rents covenants and agreements herein after mentioned specified and referred and which on the part and behalf of the said Ralph Longworth his Executors Administrators and Assigns are and ought to be paid done observed and performed hath Demand Granted Sett and to farm letten AND by these presents Doth Demise Grant and Sett and to farm let unto the said Ralph Longworth his Executors Administrators and Assigns All that Messuage Farm or Tenement  Situate within Turton aforesaid and commonly called and known by the name of Tongue-fields together with all and singular the houses out-houses, Edifices and Buildings standing and being on a certain plot of land within Dunscar Croft ajoining Closes Inclosures and parcels of ariable Meadow and Pasture Ground, Moors, Waists, mosses, Commons, Commons of pasture, and Turbary ways, Roads, Rights, Waters, Water-courses, Liberties, easements, privilidges, advantages and apputenances whatsoever to the said Messuage, tenement, Cottage and premises hereby Demand or any part thereof belonging or in anywise appertaining or therewith usually Occupied or Enjoyed.

TO HAVE AND TO HOLD the said Messuage Tenement Lands and all other the premises herein before mentioned or intended to be demised with theirs and ever of theirs Appurtenances unto the said Ralph Longworth his Executors Administrators and Assigns in manner following, to wit ALL the Meadow and Pasture Ground from the Twenty fifth of March now last past and the said Messuage Cottage and out-housing and one pasture field for outlet from the twelveth Day of May also last past for and during the term of Eleven Years from the said several Days next respectively ensuring and fully to be compleat and ended YIELDING AND PAYING therefore Yearly and Every Year durign the three first years the annual or yearly Rent or Sum of Thirty-four pounds of lawful British Money, And the other Eight years the annual or Yearly Rent or sum of Thirty five pounds of lawful British Money by two equal payments in the year that is to say on the second Day of November and the second day of May the first payment to begin and be made at and upon the second day of November next ensuring the commencement of this Demise.  AND the said Ralph Longworth hereby for himself and Heirs Executors and Administrators and every of them doth Covenant promise and agree to and with the said John Haslam His Heirs Executors Administrators and Assigns by these presents that he the said Ralph Longworth his Heirs Executors Administrators and Assigns or some of them shall and will well and truly pay or cause to be paid unto the said John Haslam and his Heirs Executors Administrators or Assigns or some of them the said annual or Yearly Rents of Sums of Thirty four pounds and of Thirty Five pounds of Lawful British Money on the Days and time and in such sort manner and form as is herein before Mentioned for payment thereof according to the true intent and meaning of these presents.  AND further also that the said Ralph Longworth his Heirs Executors or Administrators nor any of them shall not and will not at any time or times hereafter during this Demise plow the Meadow or any part thereof or cause to be plowed nor shall plow or cause to be plowed above some one [blank space] of the pasture fields in any one years during the said Term but shall and will forfeit and pay over and above the yearly Rent hereby reserved unto the said John Haslam his heirs Executors or Administrators the sum of Five Pounds of Lawful  British Money  for every Acre of Ground which he or they shall plow or cause to be plowed in any one year, over and above what is herein specified, and so proportionably for every Greater or Lesser quantity then an Acre the same to be paid (if any happen).
