1779 Contract to Purchase the Old Wool Pack in Bolton

A Contract Bargain and Agreement made and agreed upon the Twenty sixth day of April in the year of our Lord one Thousand Seven Hundred and Seventy Nine BETWEEN Adam Lomax of Dunscar within Turton Gentleman, Samuel Simpson of Bolton Gentleman, Peter Marsh of Breightmet Yeoman, Thomas Cross of Ainsworth Yeoman, John Marsh, Samuel Marsh and John Longworth of Horwich, Yeoman (persons interested in or appointed to Sell and Convey Title to the premises now in after mentioned, of the one part and William Holden of Bolton aforesaid, Chapman and John Brown of Bolton aforesaid Gentleman of the other parts as Follows.


FIRST the said Adam Lomax, Samuel Simpson, Peter Marsh, John Marsh, Samuel Marsh, Thomas Cross and John Longworth Do hereby promise and agree to and with the said William Holden and John Brown That they the said Adamin Lomax, Saml. Simpson, Peter Marsh, John Marsh, Samuel Marsh, Thomas Cross and John Longworth or some of them shall and will on or before the twelfth day of November next at the purchasers expense Convey or cause to be conveyed a good and sufficient Title such as Counsel learned in the Law shall approve of To ALL that one Capital Messuage or Dwelling House known by the name of the Old Wool Pack in Bolton aforesaid together with the warehouse or Kitchin, the Brewhouse the Stable the Little Shop the Back yard the new and old Little houses of Conveniences the Garden and also three other cottages or Dwelling houses near adjoining in Bolton aforesaid and apurtenances there unto respectively belonging ALL which said premises are now in the tenure holding and Occupation of the said William Holden, Mary Holden, Jane Goffog, Edward Rothwell and James Cooper.  Except and reserved to the Sellers their Heirs and Assigns the Usual priviledges to the Little House in the Passage and the Pump in the Back yard and the said William Holden and John Brown to hereby promise and agree to pay or cause to be paid to the said Adam Lomax, William Wood of Liverpool, Gentleman, Peter Marsh, John Marsh, Thomas Cross, Sahuel Marsh and John Longworth or some of them for the purchase of the said permises, Nine Hundred and sixty four pounds of lawful British Money on the Executing of such Conveyance AND it is further agreed between the said parties that the Sellers shall have the next Marhnmas[?] half years Rent and the purchasers shall then enter into immediate possession of either the premises or the then ensuing Rents and it is further mutually agreed upon that the Families of the vendors shall be allowed by the purchasers to have the free priviledge of Four Seats in the pew within the Parish Church of Bolton usually held and enjoyed to the said persons at their own pleasure only for their own use but not for others.  The purchasers shall repair and keep open the Channel running down the west side of the Backyard.  William Holden or hr his order shall and will pay the clear rent or sum of Fifteen pounds for the next first half year.  The Sellers shall pay the sixpence of a Fine, provided the said Adam Lomax and Edmund Howarth must have the benefit of Drawing a proper Conveyance and good Title at a fair price AND the said William Holden and John Brown have repossited and paid into the hands of the said Adam Lomax the sum of Five pounds and two shillings which shall be reckoned in part of the purchaser money and the same shall be forfeited to the sellers if the rest of the purchasers money be not paid to the vendors at the time appointed and the sellers shall afterward have free liberty yo resell the said premises by publick or private sale and the Defficiencey (if any there should be) by such second sale together with all Charges attending the same shall be paid and made good by the said William Holden and John Brown and they do accordingly hereby promise and agree to forfeit the said Deposit Money and pay and make good such Deffiniency in the case of Default of payment of the remainder of the purchase Money at the time appointed for payment thereof as aforesaid and the purcahsers will and shall be subject to the articles between the late Dr. Dutton and Mistess[?] March with regard to the prouws[?] between them as witness their hands.
